coondoggie writes "A federal court today spanked two telemarketers with some $1.2 million in civil penalties for violating the Federal Trade Commission's Do Not Call Rule. According to the FTC, the companies called consumers whose phone numbers were on the Do Not Call Registry without having obtained their express written agreement or having an 'established business relationship' with them. One group's telemarketers also allegedly abandoned many calls, by failing to connect the calls to a sales representative within two seconds after consumers answered, as required by law, the FTC stated. J ROC writes "Phone numbers on Canada's Do-Not-Call registry have apparently been sold to off-shore telemarketers, scam artists, and other ne'er-do-wells, according to reports in the Globe & Mail and CBC News. The CRTC, which runs the registry, sells lists of phone numbers online for a small fee; making it available to anybody who might be interested in buying it, including con artists. I guess this explains why, ever since I added my number to the registry, I've been getting phone calls from 000-000-0000 trying to interest me in some free vacation scam. coondoggie writes to tell us that in a recent report to Congress by the FTC the National Do Not Call Registry got glowing reviews. They seem to be well established now with $21 million in fees in the bank, 22 successful court cases, and an almost 70% approval rating. "In 2007, a total of 6,242 entities paid fees totaling $21,602,003 for access to the National Registry. According to the FTC, telemarketers and sellers can access registered telephone numbers and pay the appropriate fee for that access, if any, through an Internet website dedicated to that purpose. The only information about consumers that companies receive from the National Registry is the registered telephone number. Since the Registry's inception, a total of 18,197 unique entities have paid fees for access to the National Registry. The total amount of fees paid by all entities since the inception of the National Registry through the end of 2007 is $80,629,778, the report stated."Read more of this story at Slashdot.

Tracking companies are asking for examples where tracking has caused harm, and would rather the industry stay self-regulated. 'In December, the FTC approved Google's purchase of advertising rival DoubleClick over the objections of some privacy groups. At the same time, the agency urged advertisers to let computer users bar advertisers from collecting information on them, to provide "reasonable security" for any data and to collect data on health conditions or other sensitive issues only with the consumer's express consent.'"Read more of this story at Slashdot.

At IOptOut.ca, Canadians can enter their phone number and e-mail address and simply choose the organizations they would prefer not to hear from while the website generates a mass request that the user be added to those companies' do-not-call lists. The site, a beta version of which was launched yesterday, is the brainchild of University of Ottawa law professor Michael Geist and features information on how to avoid telemarketing calls from more than 140 different companies and organizations. coondoggie passed us a NetworkWorld article about an initiative by the Senate to transform the Do Not Call list into a permanent institution. Originally individuals on the list were to have their place on the list revoked; up to a third of the people who signed up might have fallen off the list by the Autumn without renewing legislation. A move by the Senate this past Wednesday will permanently prevent salesmen from calling those who have registered for the list. "Aside from what telemarketing junk the bill does prevent, experts note what may also be a big deal is a provision that is NOT in this bill and that is protection for those other annoying time wasters: political robo calls."Read more of this story at Slashdot.

Tech.Luver writes "The Federal Trade Commission today announced a law enforcement crackdown on companies and individuals accused of violating the requirements of the National Do Not Call Registry, resulting in six settlements collectively imposing nearly $7.7 million in civil penalties, along with an additional complaint that will be filed in federal district court. The actions, brought by the Department of Justice on the FTC's behalf, are against companies ranging from adjustable bed seller Craftmatic Industries, to alarm-monitoring provider ADT Security Services and lender Ameriquest Mortgage Company. Technical Writing Geek writes with a Reuters story about a collection of privacy groups looking to set up a 'Do Not Track' list online, similar to the 'Do Not Call' list meant to dissuade telemarketing. "Computer users should be notified when their Web surfing is tracked by online advertisers and Web publishers, argue the Consumer Federation of America, the World Privacy Forum and the Center for Democracy and Technology, among other groups in a coalition promoting the idea. Rather than burying privacy policies in fine print, companies should also disclose them more fully and provide easier ways to opt out, the groups said. Canada's telecommunications regulator has laid out new rules for a national do-not-call list. Under existing rules, consumers have to register separately to be on the "do not call" list of each individual telemarketer but in a few months, Canadians will be able to add their phone or fax numbers to the list at no cost for a period of three years. Some telemarketing calls will be exempt from the new regulations, including calls from registered charities, political parties, opinion polling firms and organizations that already do business with a particular household.The Canadian Radio-television and Telecommunications Commission said it is in the process of issuing a request for proposals to select an independent operator of the list. It said the rule changes were triggered by widespread complaints from consumers that telemarketing calls were a nuisance and an invasion of privacy. BrentRJones writes "I signed up for the Do Not Call registry the first day I heard of it, and I have to say that I have gotten very few telemarketers calling over the past couple of years. However, there now seems to be more calls that start, 'This is a survey...' or some other such excuse. I do not mind getting a few charity appeals or calls from those I have done business with in the past, but I do wish that I could avoid the political phone calls. I am curious what other Slashdot folks are experiencing, and I am also wondering if I say, 'Please remove from any list that you have.' when I am called, will this do any good?"
